Estos Términos y Condiciones ("Términos") regulan el uso del sitio web mentalidad-invicta.com y de los servicios prestados por Mentalidad Invicta LLC, sociedad de responsabilidad limitada constituida en el estado de Florida, Estados Unidos (en adelante, "la Empresa", "nosotros" o "Mentalidad Invicta").
Al contratar, registrarse o utilizar cualquier programa, mentoría o membresía, usted ("Cliente" o "usted") declara haber leído, comprendido y aceptado estos Términos en su totalidad.
1. Aceptación de los Términos
El acceso y uso del Servicio implica la aceptación expresa e incondicional de estos Términos. Si no está de acuerdo, debe abstenerse de utilizar el Servicio.
2. Elegibilidad
Para contratar nuestros servicios, usted debe:
- Tener al menos 18 años de edad.
- Tener capacidad legal para celebrar contratos vinculantes.
- Contar con la autorización médica correspondiente si presenta condiciones de salud preexistentes.
3. Descripción de los Servicios
Mentalidad Invicta ofrece servicios de coaching de fitness, nutrición y mentalidad, que incluyen:
- Programas (1, 2 o 3 meses): planes de entrenamiento, guía nutricional y check-ins periódicos.
- Mentoría VIP 1:1: sesiones individuales semanales, plan personalizado y soporte directo.
- Membresía Mentalidad Invicta: acceso a comunidad privada en Discord, sesión grupal semanal y precios exclusivos.
El alcance específico de cada servicio se detalla en la página correspondiente al momento de la contratación.
4. Precios, pagos y métodos
Los precios se publican en USD (dólares estadounidenses). Aceptamos los siguientes métodos de pago:
- Stripe — tarjeta de crédito/débito.
- Whop — checkout para membresías recurrentes.
- Zelle — transferencia directa (solo USA).
El servicio se activa una vez verificado el pago. Los impuestos aplicables, si los hubiera, serán informados antes de la confirmación.
5. Política de no reembolso (final sale)
Las únicas excepciones serán cobros duplicados verificables o errores técnicos atribuibles al procesador de pagos, que serán reembolsados previa validación.
Las membresías recurrentes (Whop, Discord) pueden cancelarse en cualquier momento desde su panel de usuario; la cancelación detiene futuras renovaciones, pero los montos ya cobrados no son reembolsables.
6. Aviso médico y asunción de riesgos
Los servicios de Mentalidad Invicta NO constituyen asesoría médica, diagnóstico, tratamiento ni prescripción de ningún tipo. Cristhian Vega y/o Mentalidad Invicta LLC no son profesionales de la salud licenciados (médicos, nutricionistas clínicos, fisioterapeutas o psicólogos).
Antes de iniciar cualquier programa de entrenamiento o cambio nutricional, usted debe consultar con un médico, especialmente si:
- Padece enfermedades cardiovasculares, metabólicas, respiratorias o musculoesqueléticas.
- Está embarazada o en periodo de lactancia.
- Tiene lesiones previas o limitaciones físicas.
- Toma medicación que pueda afectar su rendimiento o salud.
El entrenamiento físico conlleva riesgos inherentes, incluyendo lesiones graves o eventos cardíacos. Al contratar el Servicio, usted asume voluntariamente todos los riesgos asociados y libera a Mentalidad Invicta LLC, sus propietarios, empleados y colaboradores de cualquier responsabilidad por lesiones o daños derivados.
7. Resultados no garantizados
Los resultados varían entre personas y dependen de factores individuales (genética, adherencia, descanso, alimentación, condiciones previas). Los testimonios y casos publicados en el sitio son ejemplos reales pero no representan una garantía de resultados similares para usted. Mentalidad Invicta NO garantiza pérdida de peso, ganancia muscular ni ningún resultado específico.
8. Propiedad intelectual
Todo el contenido del sitio y de los programas (planes, videos, documentos, marca, logos, textos) es propiedad exclusiva de Mentalidad Invicta LLC y está protegido por las leyes de propiedad intelectual de Estados Unidos y tratados internacionales.
Se le otorga una licencia personal, limitada, no exclusiva y no transferible para usar el contenido únicamente con fines personales. Queda expresamente prohibido:
- Reproducir, distribuir, vender o compartir el contenido con terceros.
- Publicar material protegido en redes sociales o plataformas públicas.
- Crear obras derivadas o utilizar el contenido para fines comerciales.
La violación de esta cláusula dará lugar a la suspensión inmediata del servicio sin reembolso y a las acciones legales correspondientes.
9. Conducta del usuario y comunidad Discord
Al participar en la membresía y comunidad Discord, usted se compromete a:
- Respetar a todos los miembros y al equipo.
- No publicar contenido ofensivo, discriminatorio, sexual, violento o ilegal.
- No promocionar productos, servicios o terceros sin autorización.
- No compartir material protegido de la membresía con personas externas.
El incumplimiento dará lugar a la expulsión inmediata del servidor sin reembolso.
10. Suspensión y terminación
Nos reservamos el derecho de suspender o terminar el acceso al Servicio, sin previo aviso ni reembolso, en caso de:
- Violación de estos Términos.
- Conducta abusiva hacia el coach, equipo o comunidad.
- Uso fraudulento de medios de pago.
- Distribución no autorizada del contenido.
11. Limitación de responsabilidad
En la máxima medida permitida por la ley aplicable, Mentalidad Invicta LLC, sus propietarios, empleados y colaboradores no serán responsables de daños indirectos, incidentales, consecuentes, punitivos o lucro cesante derivados del uso o imposibilidad de uso del Servicio.
La responsabilidad total agregada de la Empresa, por cualquier reclamo, no excederá el monto efectivamente pagado por usted en los seis (6) meses anteriores al hecho que da origen al reclamo.
12. Indemnidad
Usted acepta indemnizar y mantener indemne a Mentalidad Invicta LLC frente a cualquier reclamo, demanda o pérdida derivada de: (a) su uso del Servicio, (b) su violación de estos Términos, (c) su violación de derechos de terceros.
13. Modificaciones
Nos reservamos el derecho de modificar estos Términos en cualquier momento. La versión vigente estará publicada en esta página. El uso continuado del Servicio tras una modificación implica aceptación de los nuevos Términos.
14. Ley aplicable y jurisdicción
Estos Términos se rigen e interpretan conforme a las leyes del Estado de Florida, Estados Unidos, sin atender a sus disposiciones sobre conflicto de leyes. Cualquier disputa derivada o relacionada con estos Términos será sometida a la jurisdicción exclusiva de los tribunales estatales y federales ubicados en el condado de Miami-Dade, Florida.
15. Resolución de disputas
Antes de iniciar cualquier acción legal, las partes intentarán resolver la controversia de buena fe mediante negociación directa por un plazo no menor a treinta (30) días. Si no se logra acuerdo, la disputa podrá someterse a arbitraje vinculante conforme a las reglas de la American Arbitration Association (AAA), con sede en Miami, Florida, en idioma inglés.
16. Divisibilidad
Si alguna cláusula de estos Términos fuera declarada inválida o inejecutable por un tribunal competente, las cláusulas restantes mantendrán plena vigencia.
17. Acuerdo completo
Estos Términos, junto con la Política de Privacidad, constituyen el acuerdo íntegro entre usted y Mentalidad Invicta LLC respecto al Servicio, y reemplazan cualquier acuerdo previo verbal o escrito.

These Terms and Conditions ("Terms") govern the use of the website mentalidad-invicta.com and the services provided by Mentalidad Invicta LLC, a limited liability company organized under the laws of the State of Florida, United States ("the Company," "we," or "Mentalidad Invicta").
By purchasing, registering, or using any program, mentoring, or membership, you ("Client" or "you") declare that you have read, understood, and accepted these Terms in their entirety.
1. Acceptance of Terms
Access to and use of the Service implies express and unconditional acceptance of these Terms. If you do not agree, you must refrain from using the Service.
2. Eligibility
To purchase our services, you must:
- Be at least 18 years of age.
- Have legal capacity to enter into binding contracts.
- Have appropriate medical clearance if you have any pre-existing health conditions.
3. Description of Services
Mentalidad Invicta offers fitness, nutrition, and mindset coaching services, including:
- Programs (1, 2, or 3 months): training plans, nutritional guidance, and periodic check-ins.
- 1:1 VIP Mentoring: individual weekly sessions, personalized plan, and direct support.
- Mentalidad Invicta Membership: access to private Discord community, weekly group session, and exclusive pricing.
The specific scope of each service is detailed on the corresponding page at the time of purchase.
4. Prices, Payments, and Methods
Prices are published in USD (United States Dollars). We accept the following payment methods:
- Stripe — credit/debit card.
- Whop — checkout for recurring memberships.
- Zelle — direct transfer (USA only).
The service is activated once payment is verified. Applicable taxes, if any, will be disclosed before confirmation.
5. No-Refund Policy (Final Sale)
The only exceptions will be verifiable duplicate charges or technical errors attributable to the payment processor, which will be refunded upon validation.
Recurring memberships (Whop, Discord) may be cancelled at any time from your user panel; cancellation stops future renewals, but amounts already charged are non-refundable.
6. Medical Disclaimer and Assumption of Risk
Mentalidad Invicta services DO NOT constitute medical advice, diagnosis, treatment, or prescription of any kind. Cristhian Vega and/or Mentalidad Invicta LLC are not licensed healthcare professionals (physicians, clinical nutritionists, physiotherapists, or psychologists).
Before starting any training program or nutritional change, you must consult with a physician, especially if you:
- Suffer from cardiovascular, metabolic, respiratory, or musculoskeletal conditions.
- Are pregnant or breastfeeding.
- Have previous injuries or physical limitations.
- Take medication that may affect your performance or health.
Physical training involves inherent risks, including serious injury or cardiac events. By purchasing the Service, you voluntarily assume all associated risks and release Mentalidad Invicta LLC, its owners, employees, and collaborators from any liability for injuries or damages resulting therefrom.
7. No Guaranteed Results
Results vary between individuals and depend on personal factors (genetics, adherence, rest, nutrition, prior conditions). Testimonials and cases published on the site are real examples but do not constitute a guarantee of similar results for you. Mentalidad Invicta DOES NOT guarantee weight loss, muscle gain, or any specific result.
8. Intellectual Property
All content on the site and within programs (plans, videos, documents, brand, logos, texts) is the exclusive property of Mentalidad Invicta LLC and is protected by the intellectual property laws of the United States and international treaties.
You are granted a personal, limited, non-exclusive, and non-transferable license to use the content for personal purposes only. The following is expressly prohibited:
- Reproducing, distributing, selling, or sharing content with third parties.
- Publishing protected material on social networks or public platforms.
- Creating derivative works or using the content for commercial purposes.
Violation of this clause will result in immediate suspension of service without refund and applicable legal action.
9. User Conduct and Discord Community
By participating in the membership and Discord community, you agree to:
- Respect all members and the team.
- Refrain from posting offensive, discriminatory, sexual, violent, or illegal content.
- Refrain from promoting products, services, or third parties without authorization.
- Refrain from sharing protected membership material with outside individuals.
Non-compliance will result in immediate expulsion from the server without refund.
10. Suspension and Termination
We reserve the right to suspend or terminate access to the Service, without prior notice or refund, in case of:
- Violation of these Terms.
- Abusive conduct toward the coach, team, or community.
- Fraudulent use of payment methods.
- Unauthorized distribution of content.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Mentalidad Invicta LLC, its owners, employees, and collaborators shall not be liable for indirect, incidental, consequential, punitive, or loss-of-profit damages arising from the use or inability to use the Service.
The Company's total aggregate liability, for any claim, shall not exceed the amount actually paid by you in the six (6) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Mentalidad Invicta LLC against any claim, demand, or loss arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of third-party rights.
13. Modifications
We reserve the right to modify these Terms at any time. The current version will be posted on this page. Continued use of the Service after modification constitutes acceptance of the new Terms.
14. Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any dispute arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
15. Dispute Resolution
Before initiating any legal action, the parties shall attempt to resolve the dispute in good faith through direct negotiation for a period of no less than thirty (30) days. If no agreement is reached, the dispute may be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), seated in Miami, Florida, in the English language.
16. Severability
If any clause of these Terms is declared invalid or unenforceable by a competent court, the remaining clauses shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mentalidad Invicta LLC with respect to the Service, and supersede any prior verbal or written agreement.
